NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy procedural requirements for activities to be undertaken by the Commonwealth of Virginia Department of Housing and Community Development (DHCD)

 

REQUEST FOR RELEASE OF FUNDS

 

On or about April 12, 2022 the Virginia Department of Housing and Community Development (DHCD) will submit a request to the United States Department of Housing and Urban Development Richmond Office (HUD) for the release of HOME funds under Cranston-Gonzalez National Affordable Housing Act, Title II, 1990, as amended, to undertake one project known as Leggett Building Apartments. The project is proposed for rehabilitation using DHCD State HOME funds in the amount of $700,000. Taylor Hollow Construction will be converting the former Leggett Building in downtown Radford into 11 mixed-income rental units. The units will be a mix of one and two bedrooms and will have elevator access, making them accessible to handicapped or senior residents. Five of the units will be affordable to households earning at or below 60% of the area median income; two units will be affordable to a household earning at or below 50% of the area median income. The vacant commercial building is located at 1129 East Main Street in Radford.  The estimated total cost of construction is $2,952,000.

 

FINDING OF NO SIGNIFICANT IMPACT

 

DHCD has determined that the project in all phases on the contiguous site will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review either electronically or by U.S. mail. PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to DHCD, 600 E. Main St, Richmond, VA  23219.  All comments received by 4:30pm April 11, 2022; will be considered by DHCD prior to authorizing submission of a request for release of funds.  Comments should specify which notice they are addressing.

 

ENVIRONMENTAL CERTIFICATION

 

DHCD certifies to HUD that Bryan Todd in his capacity as Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the DHCD to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and DHCD certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of DHCD; (b) the State has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email or phone in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the HUD Richmond CPD Office at the following address: CPD_Covid-19environmentalobjectionsRIC@hud.gov, or by phone at (804) 842-2610 Potential objectors should contact the HUD Richmond CPD Office via email to verify the actual last day of the objection period.
